WV DTC Rules Update

Wine Institute has received new guidance from the West Virginia Alcohol Beverage Control Administration (WVABCA) that will make it easier for members shipping wine into WV to comply with the law. WV statute has always mandated the inclusion of Blood Alcohol and Fetal Alcohol Syndrome Charts in each shipment of wine to a West Virginia consumer. However, rather than including these two paper documents within wine shipments to WV customers, a winery holding a Direct Shipper license may now send an electronic communication to its consumers after a sales transaction has been made. Such notice should direct consumers to the WVABCA website containing the Blood Alcohol and Fetal Alcohol Chart, with a statement, which reads as follows:

As required by West Virginia law, customers may access important information about the effects of alcohol from these links to the West Virginia Alcoholic Beverage Control Commission:

Fetal Alcohol Syndrome

Blood Alcohol

To ensure compliance wineries must ensure that all links are maintained and consumers are directed to the accurate documents.
